120 Days to Give Notice of a Work Injury in Pennsylvania

Question: Is there a time limit on how long I have to report a work injury to my employer? Also, is there a time limit to file a claim with the workers comp (workers compensation) insurance company?  D. H., (City name withheld), Pa.

Answer: You should make every effort to report a work injury to your employer as soon as possible after the injury occurs. Under Pennsylvania law, you have 120 days to provide your employer with notice of a work injury. The 120 day notice period begins to run from the time that you know- or reasonably should have known- that your condition or injury is work-related.

A claim for workers compensation benefits in Pennsylvania must be filed within 3 years of the date of injury.
