In February, 2012 the Pennsylvania Legislature passed the natural gas drilling “impact fee” bill taxing drilling rig sites in Pennsylvania.  Included in the new law were provisions eliminating local zoning powers of municipalities to govern location of gas drilling rigs.  Several towns appealed this portion of the law claiming that it was unconstitutional.  The Commonwealth Court enjoined the new law pending review.  As of today the case is still pending and no decision has been rendered.  Interestingly, when word got out that natural gas reserves might be found under Buck’s County, Republican Senators from that region sponsored and had passed a bill placing a moratorium on gas drilling in the area.  These same legislators touted the revocation of zoning rights and drilling in other parts of the State.
