Act 34, the new state law that imposed an impact fee on gas drilling rigs in Pennsylvania, also contains provisions preempting traditional local zoning laws and permitting the construction of natural gas drilling rigs and wells,  waste ponds, pipelines and other gas drilling related items in residential areas provided buffer zones are constructed.  The zoning rules were challenged by seven (7) municipalities in Commonwealth Court.  Yesterday a seven (7) member panel of judges heard argument on the new law which has been suspended and held in limbo for the past couple of months.  A decision by the Court should be made as to the validity of the new zoning rules in the near future.
