Lycoming County Judge Denies Gas Drilling in Residential Zoned Location

Last year the Pennsylvania Supreme Court issued its decision in Robinson Township  v  Commonwealth.  The Court ruled that local zoning ordinances trump the new anti local zoning provisions of Act 13 (the law governing natural gas production in Pennsylvania).  In a case of first impression, a Lycoming County judge has ruled that natural gas drilling and fracking will not be permitted in a portion of a community zoned for residential and agricultural use.  Citing the Robinson Township case, the judge held that natural gas drilling and fracking was excluded by the zoning code and its requirements.   This is the first of many expected decisions which will cite the Robinson Township decision.
