When you purchase a product, you typically presume it is safe and will appropriately perform its desired function. However, this isn’t always the case. Over 20,000 people are killed each year by products that are dangerous or defective. Furthermore, approximately 30 million people have suffered injury or illness due to a defective product. These hazardous and even deadly product defects are known as product liabilities.
Product liability refers to the liability of parties involved in constructing unsafe products. These parties may include the manufacturer of parts, assemblers, wholesalers, and those on the retail level.
Any product that causes harm to a consumer is subject to a product liability lawsuit. The defendant is liable when a plaintiff can prove that the product in question is defective. In this instance, the defendant’s intent is irrelevant. If the product is faulty, the defendant is liable.
If safety and consumer protection laws are in place, how come so many deaths and injuries result from poor products? Although safety standards are in place, sometimes product manufacturers don’t strictly abide by the rules. As more products are being imported from other countries with differing safety laws, these defective products are a growing concern. There are instances where consumers are injured when product recalls are not implemented promptly.
