Question: I twisted my ankle at work. The workers compensation company has been paying my medical bills for treatment of my ankle. I missed 3 days at the time of the injury and I have missed 3 more days since the injury due to pain in my arm for a total of 6 days. My ankle feels pretty good. I saw the doctor today and she cleared me for “full duty”. Can I collect workers comp for the 5 days that I missed? A.R. Moscow, PA.
Answer: The Pennsylvania Workers Compensation Act states that if disability from a work-related injury lasts for less than 7 days, no wage loss benefits are payable. If disability lasts for more than 7 days but less than 14 days, wage loss compensation is paid for each day of disability extending from day 8 to day 13. If disability lasts for 14 or more days, wage loss benefits are payable retroactive to the first day of disability. As your injury resulted in less than 7 days of disability- or inability to perform your job- no wage loss benefits would be payable to you.
