Workers’ Compensation Rights in Pennsylvania are constantly changing since the first Act was passed on this in 1915. Since then, it has been updated to reflect changes in society, and more recently, the weekly wage has fluctuated to reflect economic changes across the state. The Worker’s Compensation Act provides compensation to individuals who suffer injuries in the course and scope of their employment. As a resident of Pennsylvania, it is important to know your rights and compensation benefits to protect yourself in the event of an accident.
Pennsylvania Workers Compensation Breakdown
Understanding the ins and outs of your rights as an employee in Pennsylvania requires knowledge of many areas. Whether that is the financial aspects, the injury rights, or making a claim, these are all important and tie in together.
The financial side of workers’ comp includes understanding the monetary benefits you can receive based on your situation or injury. As our DLP Law experts have shared, monetary benefits are payable if the claimant, or the injured worker, can establish disability. Benefits can also be payable if the claimant can establish that they suffered an occupational disease from their employment, and the amount of disability benefits is usually calculated as two-thirds of the pre-injury earnings. If this holds, the employer will be liable for necessary and related medical bills arising from the work injury or occupational disease. In order for your claim to process in most cases, notice of the injury must be given within 120 days of the injury date.
Workers’ Compensation benefits in Pennsylvania are available only to hired employees; therefore, these rights are not available to independent contractors. This may appear to be a simple process, but complications and disputes can quickly occur. Questions about the scope of employment, whether the disability is non-work-related, or whether this is a true-life-altering disability often come up in these cases. If you have any questions regarding a work-related injury, a DLP lawyer is available to answer your questions and assist with your needs.
Recent Pennsylvania Law Update on First Responders Coverage
Every employment sector is different and has its own alternative regulations for workers’ comp. For example, a finance firm has different workers’ comp regulations than a first responder, due to the major difference in physicality between the two jobs.
For first responders, a new compensation area is now available. Notably lowering the burden of proof for first responders, the ‘Act 121 of 2024’ took effect this past October. This act, aimed at Police Officers, Firefighters, and EMTs who claim post-traumatic stress injury (PTSI) from their jobs, is now making it easier for them to establish a claim. As the PA Fire Police Association shared, “they no longer need to prove ‘abnormal working conditions’ but only that the PTSI resulted from a ‘qualifying traumatic event’ experienced on the job.” As mental injury claims are typically very hard to establish, this Act now allows our first responders across Pennsylvania to get access to the compensation they need to serve our communities. As PA residents protected daily by the services of Firefighters, Police Officers, and EMTs statewide, it is important that we advocate for the protection of their rights as well as our own.
