Updates on CMS Plan to Appeal Nursing Home Staffing Rule

As shared in early September, the Centers for Medicare & Medicaid (CMS) has plans to change their staffing rules across nursing homes. The CMS is making an effort to revoke its previous staffing rule from 2024 that called for low staffing levels across facilities. The new mandate, ‘Repeal of Minimum Staffing Standards for Long-Term Care Facilities,’ is under review by the Office of Management and Budget now. This proposal would withdraw the measure, which was strongly opposed, that faced challenges in court and was delayed by Congress. Furthermore, the congressional moratorium delayed the rule in the Fiscal Year 2025 budget until 2036.

With many oppositions coming its way, the White House Office of Management and Budget are keeping many details under wraps as they deal with the ruling. Experts are unsure if this rule would rescind the entirety of the staffing rule or just the parts involving regulations and RN coverage plans. A spokeswoman from the American Healthcare Association, Rachel Reeves, told McKnight’s Long-Term Care News her thoughts on what is to come from the case. Reeves shared, “We’re grateful to see that CMS intends to rescind the staffing mandate. Congress and the courts have spoken on this issue, and it’s encouraging that the Administration appears to be following suit. Not only do we need to ensure that federal regulators do not exceed their authority, but rescinding this rule will also safeguard access to care for millions of seniors for years to come…We welcome the opportunity to work with CMS and Congress on pursuing more supportive policies to strengthen our workforce and enhance quality care in America’s nursing homes.” As healthcare experts share their support for residents and advocate for better quality of care in nursing homes, optimism remains strong on the ruling.

Considering that about 75% of nursing home residents rely on CMS payments for nursing home care, the CMS plans to take action on this ruling to fund those in need of medical care.
